Documents signed in the UAE

Getting UAE-Signed Documents Accepted in India

For the UAE the usual route is attestation by an Indian mission. Confirm what the receiving authority in India needs before you sign.

Indian Embassy or Consulate attestation

  • The Embassy of India in Abu Dhabi and the Consulate General of India in Dubai provide attestation for documents to be used in India.
  • For a power of attorney, the executant generally appears in person with the original passport and signs before the consular officer.
  • Check the mission website for current timings, fees, photographs and copies required, and whether an appointment or outsourced centre is involved.
  • Apostille is not the usual route for documents prepared in the UAE for use in India.

Before you sign

  • Get the draft power of attorney or affidavit prepared or reviewed by your lawyer in India.
  • Keep the text specific — the property, the acts allowed and the time period.
  • Carry your passport, Emirates ID and copies of the property papers.
  • Some banks and builders in India have their own formats — ask for them in advance.

Once the document reaches India

  • Have it stamped in India within three months of receipt, as the applicable stamp law requires — usually by adjudication at the stamp office.
  • A Power of Attorney used to register a sale or other deed must satisfy the authentication requirements of the Registration Act, 1908.
  • Register the deed where registration is compulsory, through your attorney holder at the sub-registrar’s office.
  • Keep scanned and certified copies — originals are sometimes retained by the registering office or a court.

Practical tips

  • Match your name exactly as it appears in your passport across all documents.
  • Send originals by tracked courier and keep scanned copies.
  • Tell your attorney holder about the three-month stamping deadline in India.
  • Revoke an old power of attorney formally if you no longer want it used.

Tax, banking & FEMA

Money Matters Between India and the UAE

Two tax systems can touch the same transaction. Take advice in India and where you live before you sign.

On the Indian side

  • Capital gains on selling property in India are taxed in India. The buyer must deduct tax at source when buying from a non-resident — under section 393(2) of the Income-tax Act, 2025 from 1 April 2026 (earlier section 195 of the 1961 Act).
  • If the TDS would exceed the tax actually due, you can apply to the Income Tax Department for a lower or nil deduction certificate before the sale.
  • Sale proceeds and other NRO balances can be repatriated up to USD 1 million per financial year under RBI rules, usually with Forms 15CA/15CB.
  • Under FEMA, NRIs and OCIs may buy residential and commercial property but not agricultural land, plantations or farmhouses — though they can inherit them.
  • Indian citizens who are not liable to tax in any other country can, in some situations, be treated as resident in India if their Indian income crosses a threshold — check your status with a tax adviser.

On the UAE side

  • Most individuals in the UAE do not pay personal income tax on salary, but Indian tax on Indian income can still apply.
  • The India–UAE tax treaty may be relevant to residence questions — take advice before relying on it.
  • Banking and remittance rules of your UAE bank also apply when you transfer funds.
  • Information on this page covers Indian law only.

Courts & family matters

Indian Court Proceedings from the UAE

Video appearance

Many Indian courts allow parties abroad to join by video, subject to each High Court’s rules and the court’s permission.

Vakalatnama

Your lawyer appears for you on a vakalatnama, which can usually be signed in the UAE and sent to India.

UAE money judgments

India has notified the UAE as a reciprocating territory under Section 44A of the Code of Civil Procedure, so certain money decrees of UAE courts can be executed in India.

Cheque bounce in India

Cheques given in India that are dishonoured can lead to proceedings under Section 138 of the Negotiable Instruments Act; strict deadlines apply.

Travel and arrest concerns

If a complaint has been filed against you in India, take advice on anticipatory bail before you travel.

Time difference

India is 1½ hours ahead of the UAE, so consultations fit easily into the working day.

FAQs

Frequently Asked Questions

Can I sign a power of attorney for India at the Consulate in Dubai?

Yes. The Consulate General in Dubai and the Embassy in Abu Dhabi attest documents for use in India. You generally sign a power of attorney in person before the consular officer.

Can I file a RERA complaint against an Indian builder from the UAE?

Yes. Most state RERA authorities accept online complaints, and your lawyer or attorney holder can appear for you.

Will a UAE court judgment be enforced in India?

Certain money decrees of UAE courts can be executed in India because the UAE is a notified reciprocating territory. Other orders need specific advice.

Do I pay tax in India on my UAE salary?

Generally not, if you are a non-resident for Indian tax purposes. Residence rules are technical, so check your status every year.

Can my family in India deal with my property while I am in Dubai?

Yes, through a properly attested power of attorney that is stamped in India and, where needed, registered.
