FAQs
NRI Legal Services — Frequently Asked Questions
Can I sell or manage my property in India without travelling?
In many cases, yes. You can appoint a trusted person through a properly executed Power of Attorney to sign documents and appear for registration on your behalf. Some transactions or states may still need your personal involvement.
How do I execute a Power of Attorney from abroad?
It is usually signed before an Indian Embassy or Consulate, or notarised and apostilled in countries that follow the Hague Apostille Convention. After it reaches India, it generally has to be adjudicated and stamped before it can be used.
Can NRIs buy agricultural land in India?
Under current foreign exchange rules, NRIs and OCI cardholders generally cannot buy agricultural land, plantation property or farmhouses, although they can usually inherit them. Residential and commercial property can generally be bought.
Do I need to be present in India for my divorce case?
It depends on the type of case and the court. Some courts allow appearance by video conferencing or through a representative at certain stages, but personal presence may be required at key hearings.
How can I claim a deceased parent's bank deposits or property?
Depending on the asset and whether there is a will, you may need a succession certificate, probate, letters of administration or a legal heir certificate, followed by mutation or transfer of the asset.
Do I have to file an income tax return in India as an NRI?
You may need to file a return if your taxable income in India is above the basic exemption limit, or in certain other situations, such as claiming a refund of excess TDS.
